1. General

1.1 These Terms of Service govern your use of tinysend's platform, APIs, dashboard, documentation, and all related services ("the Service").

1.2 By accessing or using the Service, you agree to be bound by these terms.

1.3 We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Service Description

2.1 tinysend is an email infrastructure platform. You bring your own email provider (Amazon SES, Postmark, Resend, etc.) and tinysend provides APIs, a dashboard, contact management, sequence automation, analytics, and delivery tracking.

2.2 tinysend does not send emails directly. Emails are routed through the providers you configure. Deliverability depends on your provider setup and sender reputation.

3. Your Account

3.1 You must provide accurate information when creating an account. You are responsible for securing your account credentials and API keys.

3.2 You are responsible for all activity that occurs under your account, including emails sent through your API keys.

3.3 Accounts created by bots or automated means are not permitted.

3.4 We reserve the right to suspend or terminate accounts that violate these terms.

4. Anti-Spam Policy

tinysend enforces a zero-tolerance policy on spam. This is critical to protecting the deliverability and reputation of every user on our platform.

4.1 You must only send emails to recipients who have explicitly opted in to receive your messages. This means they gave clear, affirmative consent (for example, by signing up on your website or checking a box). Pre-checked boxes, purchased lists, and implied consent do not qualify.

4.2 You must never send emails to purchased, rented, scraped, harvested, or third-party lists, regardless of how those lists were obtained.

4.3 Every marketing email you send must include a clear, working unsubscribe link. Unsubscribe requests must be honored within 24 hours. tinysend provides automatic suppression list management to help you comply.

4.4 You must not send content that is deceptive, misleading, or fraudulent. Subject lines must accurately reflect the content of the email. Sender names and addresses must not impersonate another person or organization.

4.5 The following types of content are strictly prohibited:

  • Phishing, scams, or social engineering attempts
  • Malware, viruses, or links to malicious software
  • Unsolicited commercial messages (spam)
  • Content promoting illegal activities
  • Emails designed to harass, threaten, or abuse recipients

4.6 Enforcement. If we detect spam or abuse, we will take immediate action, which may include: suspending your sending ability, terminating your account without refund, and reporting violations to relevant authorities and anti-spam organizations. We monitor bounce rates, complaint rates, and spam trap hits. Accounts with excessive complaints will be suspended automatically.

5. Email Compliance

5.1 You are solely responsible for complying with all applicable email laws in your jurisdiction, including but not limited to CAN-SPAM (US), GDPR (EU), CASL (Canada), PECR (UK), and any other local regulations.

5.2 Where required by law, you must include a valid physical mailing address in your emails.

5.3 If you send marketing emails, you must provide recipients with a clear way to opt out and you must honor those requests promptly.

5.4 tinysend provides tools for unsubscribe management, suppression lists, and bounce handling. It is your responsibility to configure and use them correctly.

5.5 You are responsible for maintaining clean contact lists. This includes regularly removing bounced addresses, unsubscribed contacts, and inactive recipients.

6. Acceptable Use

Beyond the anti-spam rules above, you agree NOT to use tinysend to:

  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Exceed reasonable rate limits or abuse the API
  • Use the Service for any purpose that is unlawful or prohibited by these terms
  • Reverse engineer, decompile, or disassemble the Service

7. Provider Credentials

7.1 You grant tinysend permission to use the provider credentials you configure solely to send emails and retrieve delivery events on your behalf.

7.2 You are responsible for maintaining valid provider credentials and ensuring your provider account is in good standing.

7.3 tinysend is not liable for provider outages, suspensions, or delivery failures caused by your provider.

8. Payments and Billing

8.1 Some features require a paid subscription or pay-as-you-go payments. Pricing is listed on our website.

8.2 Subscriptions renew automatically unless cancelled before the renewal date.

8.3 We reserve the right to change pricing with 30 days notice.

8.4 Refunds are available within 7 days of purchase if you are not satisfied, subject to reasonable use.

9. Intellectual Property

9.1 The tinysend platform, including its design, code, and documentation, is our property and protected by copyright.

9.2 You retain ownership of all content you send through the platform (email content, templates, contact data). You grant tinysend a limited license to process this content solely to operate the Service.

10. Disclaimer of Warranties

10.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10.2 WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, EMAIL DELIVERY, OR SPECIFIC DELIVERABILITY RATES. DELIVERY DEPENDS ON YOUR PROVIDER AND SENDER REPUTATION.

11. Limitation of Liability

11.1 tinysend shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including lost profits, lost data, or business interruption.

11.2 We are not liable for consequences of email delivery failures, bounces, spam filtering, or provider issues.

11.3 Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless tinysend from any claims, damages, or expenses arising from your use of the Service, the content of emails you send, your email sending practices, or your violation of these terms or any applicable law.

13. Termination

13.1 You may cancel your account at any time. Upon cancellation, your sending ability will stop immediately.

13.2 We may suspend or terminate your account immediately and without notice if you violate these terms, especially the anti-spam policy. Terminated accounts forfeit any remaining subscription period.

13.3 Upon termination, we will delete your data within 30 days, unless retention is required by law.

14. Governing Law

14.1 These terms are governed by applicable law, without regard to conflict of law principles.

14.2 Disputes shall be resolved through binding arbitration.
